A Logan County Grand Jury handed down a second indictment against Clark County resident Brandon Murray.

Based on a public records request Murray will be facing charges for a second time of Rape and Gross Sexual Imposition with the added charge of Sexual Battery.

The Grand Jury agreed that the new charge of Rape which includes a narrative stating that the victim did not have the ability to “resist or consent” and was “substantially impaired because of a mental or physical condition” and that the defendant “knew or had reasonable cause to believe” that she did not have the “ability to resist or consent.”

On the added count of Sexual Battery, the Grand Jury found that Murray did engage in sexual conduct with the victim knowing that she did not have the “ability to appraise the nature of or control of her conduct was substantially impaired.”

Jurors agreed that the new count of Gross Sexual Imposition was valid in the new filing which states that the ability of the victim to resist or consent was “substantially impaired because of alcohol impairment” and the defendant was aware or “had reasonable cause to believe” this to be the case.

The summons issued on April 11, 2018 requires Murray to appear in court on Friday, April 13 before the judge however his attorney is “arranging a date with the court when he will be arraigned” according to information provided by the Logan County Prosecutors Office.

The charges stem from an incident which occurred in the parking lot of Froggy’s a bar located at Indian Lake in Logan County on June 25 of last year.

The 12 member jury in the first case could not come to a unanimous decision and the judge in the case declared a mistrial after a day and a half of deliberations.

Rape is a first degree felony in the State of Ohio. Sexual Battery is a third degree felony and Gross Sexual Imposition is a fourth degree felony.
