Convicted sex offender Gary Grubb’s sentencing was continued March 23 but he ended up back in jail after Miami County Judge Jeannine Pratt found he violated conditions of his release when he hugged a girl outside the courtroom.

Grubb, 52, of Bethel Township, Miami County, pleaded guilty Feb. 2 in Common Pleas Court to three felony counts of gross sexual imposition of a child under age 13 as part of a plea deal in which prosecutors dismissed a rape charge.

He was accused of sexual contact with a minor under age 13 in 2011. The deal also included a recommended eight-year prison term.

The sentencing scheduled March 23 was continued one week at the request of Grubb’s new lawyer, Scott Kelly of Troy. He told Pratt he had recently been hired by Grubb’s mother to represent her son and wanted to better familiarize himself with the case including the presentence investigation report.

Grubb had been on a recognizance bond and medical furlough since fall due to surgery and the jail’s inability to accommodate his needs for a special bed and other care at the time. He had previously attended court hearings in a wheelchair but was using a walker March 23. Kelly, though, told Pratt that Grubb continued to experience medical challenges.

The recognizance bond was revoked after Paul Watkins, assistant county prosecutor, asked the judge to take that action.

Watkins explained that Grubb was seen outside the courtroom before the hearing standing next to a young girl. As part of his bond, Grubb was ordered to have no contact of any kind with any minor.

Pratt questioned Grubb about the incident, reminding him that at each hearing she had emphasized the no contact order.

“It shocked me,” Grubb said of the incident.

Pratt said she, too, was shocked and told Grubb he should have avoided the girl. “You are the adult,” she said, ordering Grubb to jail pending sentencing now scheduled for March 30.
